The Service Contract to which this Amendment is attached is modified by adding the Septic System located at the address shown above as a Covered Product. Coverage on the Septic System is subject to all the terms and conditions in the Service Contract to which this Amendment is attached as well as the provisions herein.
Definitions
- Septic System - the septic tank in which raw or untreated sewage is collected from the home and through which it flows out of from connected inlets and outlets.
- System Malfunction – the failure, due to normal wear and tear, of any septic system component to perform properly where such failure results in the discharge of untreated or partially treated sewage from the Septic System to the surface. This does not include routine maintenance or where only pumping of the Septic System is required or performed.
- Emergency Situation – A situation in which We, in Our sole discretion, determined that the System Malfunction renders Your home uninhabitable or creates a dangerous or immediately hazardous condition.
The
WHAT IS COVERED provision in the Service Contract is deleted and replaced with the following:
The Septic System is covered for a System Malfunction as indicated below and subject to all other provisions of this Service Contract, including but not limited to the General Exclusions, Service Fees and Limits of Liability.
INCLUDED: septic tank or aerated chamber (including aerated chamber internal components such as aerators, pumps, controls, valves, riser rings and lid); effluent pumps and piping; distribution box and connecting piping and valves; soil absorption field and associated piping; main line stoppages/clogs (one time only and You must have existing excess or clean out); peat replacement (up to the limit shown on the Confirmation Page).
EXCLUDED: collapse of or damage to line from house caused by roots, rocks or earth movement; title fields; leach tanks; cesspools; seepage pits; lack of capacity, adequacy, efficiency, design or improper installation; clean out or pumping of septic tank; components not listed
If We determine a System Malfunction is an Emergency Situation, We will request immediate service and have service completed as soon as possible even if necessary outside of normal business hours. Non- emergency situations will be addressed during normal business hours.
Routine Pumping – In order to continue this Service Contract You must have the Septic System pumped and a visual inspection performed, at Your expense, at least once every five (5) years. We may require You to submit proof in order to renew the Service Contract and/or at the time of a claim.
WHAT IS NOT COVERED (GENERAL EXCLUSIONS)
In addition to the exclusions in the Service Contract, We will not pay for:
- Gradual reductions in performance due to normal wear and tear where no System Malfunction has occurred;

Repairs or replacements that is the result of any abuse to the Septic System causing damage such as:
- Greater than normal amounts of household cleaners or harsh chemicals, paints, solvents, oil, or similar materials not typically found in domestic sewage or sewage tanks, are used and discharged into the system.
- Installation of a subsurface automatic lawn sprinkler system which discharges water over the area where the soil absorption unit of the Septic System is located.
- Vehicles heavier than a riding lawnmower being driven on the soil absorption unit.
- Directing drain water from gutters, footing drains or other surface water into the Septic System.
- Hydraulic overload. That includes and is not limited to, running more water into the Septic System than it was designed to receive.
- Using the Septic System for a purpose other than that which it was specifically designed.
- Costs associated with the treatment, removal, recovery, disposal, transport or storage of any known, unknown or suspected toxic or hazardous substance or material;
- Residential property where all utilities related to the Septic System were not in service throughout the Contract Term;
- Costs associated in obtaining permits;
- Any liability for bodily injury or property damage to You or a third party, including but not limited to liability arising out of damage, contamination, or any other loss to ground water and soils below or above the ground water level, and remediation to property;
- Any costs associated with excessive or inadequate water pressure, electrical surge or outage, currents artificially generated, wiring not to code or inadequate amperage;
- Any damage to the physical structure of the home as the result of a System Malfunction.
This Service Contract Amendment is subject to all the definitions, terms, conditions, limitations and exclusions of the Service Contract to which it is attached, except as provided herein.
